1. contracts

our services as a real estate agent comprises in general the mediation of real estate objects for the respective client. In general a service contract will be set up in order to do so. This contract is not limited to writing only. Also an inquiry on an object or the receival of an exposée put a contract between client and agent into effect. In general our agency Service is free of charge for the seller. A claim for commision is in effect after a successful mediation, before there is no claim.

 

2. dual agency

Dual activities for both parties on basis of a commision claim is allowed. Nevertheless details have to be set up via contract. 

 

3. disclaimer

The offers and the exposées created by Zamox are based on information transmitted by the customer. A warranty for the accuracy and completeness of these information is not given. This warranty has to be covered by the respective client providing the information. All offers are non-binding. All offers in the database are subject to change/ addition / deletion (without prior notice) and subject to intermediate sale or interim leasing. 

 

4. Disclosure to third parties

Our offers are for the eyes of the respective client only. A passing on of these offers is in need of our explicit approval. In case a contract is made as a consequence of the disclosure of that particular offer will lead to a claim of commision towards the initial recipient of that offer, that passed on the information.

 

5. commission

We can only raise a claim of commision in the following cases: When a contract (sale or lease) is set up as a result of our mediation we can set a claim for commission. In case of sale the commission rate is in general 5% plus VAT derived from the sales price, due on signature of the contract. Sales commission can be agreed upon individually. On a successful lease the commission rate is in general 299€ plus VAT due on signature of the contract.

 

6. legal validity

In the case that parts or certain wordings are no longer valid, or not to the full extent, the rest of these terms and conditions shall render unaffected and stay valid. The invalid condition shall be replaced by an appropriate condition that comes close to the original intent of that condition. 

 

7. Place of jurisdiction and place of fulfilment is Bocholt.
